2022. 4. 25. ‘대통령 소속 군사망사고진상규명위원회’(이하 위원회)는 故변희수 하사 사망 사건에 대한 직권조사 결과를 발표하며 국방부장관에게 변희수 하사의 사망 구분을 순직으로 심사 할 것을 권고하였다. ‘변희수 하사의 복직과 명예회복을 위한 공동대책위원회’(이하 ‘공대위’)는 위원회의 권고를 진심으로 환영한다.

경찰의 변사사건 수사 결과 변 하사의 사망 시점은 2021. 2. 27.이 명백함에도 불구하고, 국방부는 그간 변 하사의 사망 시점을 시신이 발견된 3.3.이라 우기며 고인과 유가족을 우롱해왔다. 법적으로 변 하사의 사망 시점이 2.28. 이전인 경우, 법원에 의해 위법한 전역처분이 취소된 변 하사는 의무복무 중인 군인 신분으로 사망한 것이 되어 ‘복무 중 사망’으로 처리되어야 한다. 이 경우 국방부는 순직 여부를 판단해야 하고, 변 하사의 사망은 국방부의 위법한 전역처분에 의한 것인바 마땅히 순직에 해당한다. 그러나 국방부는 위법 처분에 대한 책임을 인정하는 것이 부담스러운 나머지 비겁하게도 경찰이 확정한 고인의 사망시점을 마음대로 바꿔 퇴역 처리 해버린 상태다. 참으로 한심한 일이 아닐 수 없다.

위원회는 조사를 통해 변 하사의 사망 시점이 2.27.이라는 점을 분명히 하며 변 하사에 대한 신변 처분을 퇴역이 아닌 복무 중 사망으로 처리해야 한다고 권고했다. 아울러 정신과 전문의 소견 및 심리부검, 고인의 마지막 메모, 강제 전역 이후의 심리 상태에 대한 주변인의 증언 등에 기초하여 사망의 주된 원인은 국방부의 위법한 전역 처분이었다고 판단했다. 따라서 변 하사의 죽음은 국방부와 육군에 귀책사유가 있는 직무 수행과 관련이 있는 사망에 해당하는 바, 순직으로 심사 할 것도 권고하였다. 이 외, 군 복무 중 성적 지향, 성 정체성 등에 따른 차별이 발생하지 않도록 인식 및 제도 개선 방안을 마련할 것도 요청하였다.

위원회의 결정을 통해 변 하사의 사망 시점과 사망 구분에 대한 황당한 논쟁에 마침표가 찍혔다. 국방부와 육군은 전역처분 취소소송에서 패소한 뒤에도 여전히 반성 없는 모습으로 고인의 명예를 짓밟아왔다. 지금이라도 차별에 기반한 위법한 처분으로 한 사람의 젊은 군인을 죽음으로 내 몬 부끄러운 과오를 성찰하고 고인과 유가족에게 진심으로 사과해야 한다. 순직 결정은 그 시작이다. 즉시 위원회의 권고를 수용하라.

The 50^th Regular Meeting was Held, Deciding 39 Cases of Truth-Finding

- The Commission closed a total of 47 cases, including 39 cases of truth-finding

- Fact-finding of Late Staff Sergeant Byun Huisu’s case and ‘Welfare Project’ Case

- Recommendations for improvement in awareness and institutions without discrimination based on sexual orientation

n Presidential Truth Commission on Deaths in the Military (Hereinafter, ‘the Commission’), headed by Song Kichun, held its 50^th regular meeting at 10:40 AM on 25 April and closed 47 cases of complaints, including 39 cases of fact-finding, which amounts to 1,130 closed cases out of 1,787 received cases with 657 cases in progress.

n The main agenda dealt in the 50^th regular meeting were as follows:

l Regarding the case of Late Staff Sergeant Byun Huisu, whose investigation was decided ex-officio by the Commission in its 45^th regular meeting in December, 2021, the Commission ascertained the truth that the deceased passed away before the expiration date of her service period by reviewing the legal proceedings and records of her revocation lawsuit, medical reports, forensic medicine consultation, psychological autopsy, and interviews with relevant figures; the military’s stance was that it cannot acknowledge her death as in the line of duty because the date of her death is after her mandatory service period. <See Annex 1.>

n Chairperson Song noted, “as the pandemic situation is improving, we can expect the investigation activities to be more vigorous,” and underscored, “it is necessary for the military to reinforce the depth and width of understanding of sexual orientation and to create an environment for military service without discrimination based on sexual orientation” in regards to, particularly, the case of Late Staff Sergeant Byun Huisu, which was investigated ex-officio.

Annex 1. Case of Late Staff Sergeant Byun Huisu (2^ndInvestigation Section, Investigator Seo Jun, Tel. 02-6124-7222)

n The Commission decided to disclose the summary of this said case since its impact on the improvement of protection and promotion of military human rights is significant and its influence on the society is highly overarching, which requires quick disclosure.

n The Commission ex-officio decided to commence an investigation, adopting Late Staff Sergeant Byun Huisu’s case as the 7^th Item for ex-officio investigation, in the 45^thregular meeting on 14 December 2021.

l The deceased was discharged on 23 January 2020 by the resolution of ‘Discharge based on mental and physical disorders’ by the Army HQ Committee on Examination for Discharge on 22 January 2020, after having sex reassignment surgery on 29 November 2019 while she had been serving the military as a staff sergeant on 1 March 2017.

l The deceased filed a lawsuit of “Revocation of Disposition of Discharge” on 11 August 2020, arguing that her forceful discharge was unjust, to the Daejeon District Court; the Court on 7 October 2021 ruled in favor of the deceased after she was found dead on 3 March 2021: “The defendant’s disposition of discharge on Late Byun Huisu, dated on 23 January 2020, shall be revoked.”

l The Commission obtained and scrutinized the revocation lawsuit’s proceedings, medical reports as well as an investigation with forensic medicine consultation, psychological autopsy, interviews with the bereaved family and important witnesses.

l The Commission confirmed the time of the deceased’s death on the basis of the Police investigation report, forensic analysis, and the medical examiner, so it concluded that the deceased passed away on 27 February before the expiration date of her noncom mandatory service period, which is 28 February 2021.

l Notably, the Commission viewed that the Court’s description, which specified the deceased’s death on 3 March 2021, is lapsus calami due to limitations of the pleading principle after reviewing the evidence submitted before the Court.

l The Commission also noted that the major cause of death is the unjust discharge on the basis of medical opinions, psychological autopsy, last memo of the deceased, testimonies of her psychological state after the forceful discharge.

l Thus, the Commission requested the Minister of National Defense to review Staff Sergeant Byun’s categorization of death as ‘in the line of duty’ as well as to swiftly arrange measures to raise awareness and reform institutions to prevent discrimination against sexual orientation, etc. in the military.
