국회 운영위, 유가족 읍소에도 누더기 군인권보호관 법안 의결
- 상임위원 증원없이 불시 부대 방문권 등 조사권 대폭 축소 -
국회 운영위원회는 오늘 군인권보호관 설치를 골자로 하는 국가인권위원회법 개정법률안을 의결하였습니다.
회의에는 고 윤승주 일병 어머니, 고 이예람 중사 아버지가 방청인으로 직접 참석하였습니다. 군인권보호관은 2014년 선임병들의 집단 구타로 사망한 윤 일병의 죽음으로 설치 논의가 시작되었으나 7년 간 국방부 등의 반대로 국회의 문턱을 넘지 못하다 이 중사 성추행 사망사건을 계기로 논의가 재개되었습니다.
유가족들은 배진교 의원(정의당 원내대표)이 국가인권위원화 위원장에게 질의하는 과정에서 유가족의 의견을 구하게 되어 발언권을 얻었습니다 유가족들은 의안으로 상정된 법안이 국방부의 요구 사항을 대거 수용한 누더기 법안임을 강조하며 군인권보호관을 맡을 상임위원 증원, 불시부대방문조사권 보장 등을 호소하였습니다.
이에 이수진 의원(더불어민주당, 동작을)이 불시부대방문조사권 보장, 강민정 의원(열린민주당, 비례)이 상임위원 증원의 수정안을 현장 발의하였으나 운영위는 이를 반영하지 않고 원안을 의결하였습니다.
군인권보호관 제도는 군에서 사랑하는 자식을 잃고 오랜 싸움을 이어가고 있는 유가족들이 같은 아픔이 되풀이 되어서는 안된다는 마음으로 7년을 기다린 법입니다. 수없이 강조한 군인권보호관의 지위와 조직 보장, 실효적 조사권 부여 등이 하나도 관철되지 않고 국방부의 입장만을 담은 법안이 통과된 데에 대하여 깊은 유감을 표합니다.
실효적 제도 마련을 위해 유가족, 인권•시민사회단체와 충분히 소통하여 제출된 이수진, 배진교 의원안 등이 있었고, 끝까지 여러 의원들이 노력하였으며, 유가족들이 직접 회의장까지 방문하여 읍소하였음에도 국방부와의 황당한 타협안을 고집하며 제도를 누더기로 만든 국회는 제도 미비로 인하여 발생할 향후의 모든 문제에 대해 엄중한 책임을 져야 할 것입니다.

Passage of the Ragged Military Human Rights Protector Disregarding the Bereaved Family's Supplication
- Without an increment in standing member position and severe reduction in the authorities such as visitation to the military base without prior notice -
- Today, the Steering Committee of the National Assembly passed the amendment bill to the National Human Rights Commission of Korea Act (NHRCK Act) whose main text is to establish an office for military human rights protection.
- In its session, the mother of late Army Private Yoon Seungju and the father of late Air Force master sergeant Lee Yeram attended as observers in person. It was after the death of Yoon in 2014 due to lynching and bullying by senior personnel when the office's establishment was initially discussed. However, due to the Defense Ministry's opposition, it has failed to cross the threshold of the legislation for seven years. After the death of Lee due to sexual harassment, the discussion gained new fuel for establishment.
- The bereaved family members were granted chances to present their opinions during a question time of Honorable Bae Jingyo (the representative of the Justice Party) to the Chairperson of the NHRCK as the lawmaker inquired on their views. The families of the deceased underscored that the presented bill is a ragged amendment which insensibly succumbed to the demands of the Defense Ministry, the government agency which needs to be supervised. They further implored the increment of a position for a standing member in the NHRCK to be in charge of military human rights as well as the power to visit a military base without prior notice.
- Upon such views, Honorable Lee Sujin (the Democratic Party, Dongjak-B Electorate) ad hoc proposed the power of visitation without notice, and Honorable Kang Minjeong (Open Democratic Party, Proportional) ad hoc proposed the increment of standing member position on the spot. Nevertheless, the Committee did not accept those but passed the original text.
- The institution of the office for military human rights protection is a law that the bereaved families who lost their beloved children in the military have waited for seven years with a spirit that the same pain shall not repeat anymore. The Center for Military Human Rights Korea cannot but express deep chagrin to see it passing a bill that only reflects the viewpoints of the Defense Ministry without guarantee of either the status and the infrastructure of the office for military human rights protection or empowerment with power of effective investigation, which have been countlessly emphasized.
- The National Assembly, which enacted a ragged bill by clinging to an absurd compromise with the Defense Ministry, shall be sternly responsible for any problems that happen due to the institutional flaws in the future. Until the end, many a lawmaker, including Hon. Lee and Hon. Bae, etc. who worked together with the families, and human rights and civil society organizations to establish an effective system. The family of the deceased even attended the session and pleaded in person.
