[조약 Treaty] '24 고문방지위 6차 최종견해 CAT 6th Concluding Observations

군인권센터는 유엔 고문방지위원회의 대한민국 6차 국가보고서 심의 과정에 참여하여 한국의 군 인권 실태를 알리고 문제점을 개선할 수 있는 권고를 도출하기 위해 노력했습니다.

위 파일은 CAT(고문방지협약위원회)에 제출한 단독보고서 및 NGO연합보고서입니다. 이를 근거로 규약위는 보고전쟁점(LOIPR)을 2020년 5월 7일 채택하였으며(6월 배포) 이에 정부가 2021년 안으로 답변을 제출해야 합니다(연기될 수 있음).

군인권센터는 앞으로 이어지는 유엔 고문방지위의 대한민국 6차 국가보고서 심의 과정에 참여하여 한국의 군 인권 실태를 알리고 문제점을 개선할 수 있는 권고를 도출하기 위해 노력하겠습니다.

고문방지위원회의 제6차 최종견해는 2024. 7. 19. 채택되어 26일 UN 누리집에 공개되었습니다. 군 인권 관련 권고가 다수 제출된 바, 아래 간단히 소개하며, 원문 등은 첨부파일을 참고해 주시기 바랍니다.

 교육·훈련 Training 

24. 보건전문가, 법집행공무원, 출입국관리공무원, 군인, 사법부 등에 고문 금지교육이 제공됨을확인하였으나 위원회는고문 및 기타가혹하고, 비인간적이며 굴욕적인 처우 또는처벌에 대한 실효적 조사와 기록 지침(이스탄불규약, 개정제10조)에 대한구체적 훈련이제공되고 있지 아니한다는 점에 우려를표한다. 

While acknowledging the training offered on the prohibition of torture to healthcare professionals, law enforcement officials, immigration officials, the military and the judiciary, the Committee regrets the lack of specific training on the Manual on the Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (the “Istanbul Protocol”), as revised (art. 10). 

25. 당사국에게 다음을 권고한다.  

The State party should: 

(a) 신입 또는 현직, 특히, 법집행공무원, 군인, 사법 공무원, 교정직원 또는 기타구류, 취조 및모든 형태의 체포, 구금, 수감자 등을 다루는사람이 고문방지협약 조항을 잘 숙지하고, 특히 절대적 고문 금지원칙과 함께 위반자를용서하지 아니하고 수사하여 책임있는 사람을 기소하고, 만약 유죄가선고되면, 합당한 처벌을 할 것이라는사실을 확실히 인지하도록 의무 연수교육과정을 추가로 개발하고 실행할 것 

Further develop and implement mandatory initial and in-service training programmes to ensure that all public officials, in particular law enforcement officers, military personnel, judicial officials, prison staff and other who may be involved in the custody, interrogation or treatment of persons subjected to any form of arrest, detention or imprisonment, are well acquainted with the provisions of the Convention, especially the absolute prohibition of torture, and that they are fully aware that violations will not be tolerated and will be investigated, and that those responsible will be prosecuted and, if convicted, appropriately punished; 

(b) 의료인을 포함한 모든 관련업무자가 <이스탄불 규약>에 따라고문 및 가혹행위사건을 식별하고 신고할 수 있도록특수 훈련을 받도록 보장할 것 

Ensure that all relevant staff, including medical personnel, are specifically trained to identify and report cases of torture and ill-treatment, in accordance with the Istanbul Protocol, as revised; 

(c) 교육 및 훈련과정이 고문 및가혹행위 사건을 감소시키는 효과 및고문 등 행위를식별, 기록, 조사 및책임자 기소를 보장하는 효과를 평가할 방법론을 개발하고 적용할 것 

Develop and apply a methodology for assessing the effectiveness of educational and training programmes in reducing the number of cases of torture and ill-treatment, and in ensuring the identification, documentation and investigation of such acts, as well as the prosecution of those responsible. 

군내 폭력Abuses in the miltiary 

26. 당사국이 군내 인권침해에 대처하기 위해 취한조치를 확인하면서도위원회는 자살을포함한 죽음으로이어지는 성폭력및 젠더 기반폭력을 포함한군내 폭력 사건증가에 우려를표한다. 나아가 「군형법」 제92조의6에서 성인간 상호 동의한 동성 성관계를범죄화하고 최대 2년의 징역형을규정한 것이 협약위반이 될 수있다는 점에 우려를 표한다. 

While acknowledging the measures taken by the State party to address human rights abuses in the military, the Committee is concerned about the reported increase in cases of violence in the military, including sexual and gender-based violence, which has resulted in deaths, including suicides. 

27. 위원회는 직전 위원회권고를 상기하며,[1]다음을 권고한다. 

The Committee recalls its previous recommendation and recommends that the State party: 

(a) 군대 내 성폭력및 젠더 기반폭력을 포함한 폭력 그리고자살을 예방하고 근절하기 위하여, 높은 압박등으로 인한 정신건강문제등 그 근본원인을 해결하는 것 그리고해당 사건의 유형을 기록하고 조사하는 것을 포함한전략과 정책을 채택하는 노력을 계속할 것 

Continue its efforts to adopt strategies and programmes for the prevention and elimination of violence, including sexual and gender-based violence, as well as prevent suicides in the military, including by addressing their root causes, such as mental health issues caused by high levels of pressure, and by monitoring, documenting and investigating this type of incidents; 

(b) 고문 및 가혹행위그리고 모든 사망사건에 대한 의혹이제도적 또는 위계적으로혐의자와 연관 없는철저하게 독립적 체제에 의하여 조사되도록 보장하고, 직접 가해자그리고 지휘계통에 있는 사람들의책임을 규명하여 법의 심판을받도록 하고, 피해자에게 배·보상할 것 

Ensure allegations of torture and ill-treatment and all cases of death, including suicides, are thoroughly investigated by an independent mechanism, with no institutional or hierarchical connection with alleged perpetrators, bring those responsible to justice by establishing the liability of direct perpetrators and those in the chain of command, and provide redress to victims; 

(c) 「군형법」 제92조의6 폐지를 검토할 것 Consider repealing article 92-6 of the Military Criminal Act.

(a) 군인의 가혹행위 및 고문에 대한 무관용을 보여주기 위해서 군대 내 성, 신체, 언어 폭력을 포함한 폭력 및 학대를 금지 및 근절할 그리고 모든 군내 학대 및 사망 의혹 사건에 대한 즉각적이며 공평하고 철저한 조사를 보장하는 조치를 강화하라 

(b) 독립 기구로서 군 부대를 감시하고 군내 학대 및 폭력 사건을 조사할 군사감독관 제도를 도입하라 

(c) 모든 군내 사망 사건을 즉시 조사하고, 직접 가해자와 지휘계통에 있는 사람들의 책임을 규명하여, 책임자를 기소하고, 행위의 강도에 걸맞는 형벌로 처벌하고, 조사 결과를 공개하라 

(d) 인권의 증진 및 보호와 관련된 군법무관의 독립성을 보장하라 

(e) 병사에 대한 사법검토 및 영장이 없는 ‘영창’ 징계를 종식하라 

(f) 군형법 제92조의6 폐기를 고려하고, 군내 성소수자(LGBTI)에 대한 폭력 행위를 처벌하기 위해 필요한 모든 조치를 취하라 

(g) 협약 제14조 이행에 관한 위원회 일반논평 제3호(2012)에 준하여 피해자에게 적절한 의료 및 심리지원을 포함한 배·보상과 재활대책을 제공하라.] 

군인권센터는 2021년 4월 2일 금요일에 열린 법무부 공청회에 참석하여 국가보고서 초안에 대한 의견을 전달했습니다. 이에 2021년 5월 28일 정부에서 답변을 하였으며 대체로 불수용하였습니다.

The Center for Military Human Rights Korea has participated in the process of the fifth periodic review on state reports to the UN Committee against Torture (CAT) in order to remind the human rights situations of Korean soldiers and to make recommendations helpful for solving the problems.

The attached compressed file contains the individual and joint submission to the CAT. The Committee has adopted a list of issues (LOIPR) and the Government should reply to them by 2021, which was finally reviewed by the CAT on 10 and 11 July 2024. The CAT delivered its concluding observations on 17 July 2024, publicized on 26 July 2024, which is included in the attached files.
