[조약 Treaty] 자유권규약위 5차 최종견해 CCPR 5th Concluding Observations

군인권센터는 유엔 자유권규약위의 대한민국 5차 국가보고서 심의 과정에 참여하여 한국의 군 인권 실태를 알리고 문제점을 개선할 수 있는 권고를 도출하기 위해 노력했습니다.

아래 파일은 CCPR(자유권규약위)에 제출한 단독보고서 및 NGO연합보고서입니다. 이를 근거로 규약위는 2019년 8월 21일 보고전쟁점사(LOIPR)을 채택하였습니다. 이에 정부가 2019년 안으로 답변을 제출(2020년 8월로 연기)해야 하였으나 다소 늦은 9월 17일 접수하였습니다. 규약위는 2023. 10. 139차 회의에서 대한민국 제5차 심의를 하기로 하였고, 군인권센터는 2023. 9. 반박보고설르 제출했습니다.

이후 위원회는 11. 3. 심의보고서 초안을 채택하였습니다.

이번 심의는 8년만에 이뤄진 심의로서 다음과 같은 구체적 군 인권 권고를 발표했습니다.

14. (b) 군인 간의 합의에 의한 동성 간 성행위를 범죄로 규정하는 군형법 제92조의6을 폐지해야 한다 

26. 생명권에 관한 위원회의 일반논평 제36호(2018)와 관련하여, 당사국은 교육, 노동 및 군대 환경에서의 매우 높은 수준의 압박을 포함하고 특히 취약한 상황에 처한 개인과 관련하여 자살의 사회적 근본 원인을 해결하기 위한 조치를 이행해야 한다. 

32. 당사국은 군대 내 인권 침해에 대한 투명하고 공정한 수사를 수행하기 위한 제도와 절차를 강화하고, 가해자가 기소되고 유죄 판결을 받을 경우 적절한 제재로 처벌되며, 피해자가 적절한 보상과 법률, 의료, 재정 및 심리적 지원을 포함한 완전한 배상을 받을 수 있도록 보장해야 한다. 또한 군대 내 인권 보호 체계를 강화하고 군대 내인권을 존중하는 문화를 조성하기 위한 노력을 강화해야 한다. 

52. 당사국은 지나치게 긴 대체복무 기간을 단축하고 교정시설 이외의 장소로 대체복무를 확대함으로써 양심적 병역거부자에 대한 차별적 처우를 없애야 한다. 또한 현역 군인도 양심적 병역거부권을 행사할 수 있도록 하고, 위원회의 이전 권고들와 개인진정 결정들에 합치하도록 2018년 6월 28일 헌법재판소의 결정에 의해 출소하여 범죄기록이 말소된 양심적 병역거부자에게 보상을 제공하도록 법령을 개정하는 것을 고려해야 한다.

The Center for Military Human Rights Korea has participated in the process of the fifth periodic review on state reports to the UN Human Rights Committee (CCPR) in order to remind the human rights situations of Korean soldiers and to make recommendations helpful for solving the problems.

The attached compressed file contains the individual and joint submission to the CCPR. The Committee will adopt a list of issues (LOIPR) and the Government should reply to them by the end of 2019 (can be adjourned). The CCPR decided to deliberate on the ROK's report in October 2023 in its 139th session, and the CMHRK submittd its shadow report in September 2023.

The Committee adopted the draft version of the concluding observations on 3 November 2023. It's been 8 years since the last recommendation, including the below points regarding the military human rights:

14. (b) Repeal Article 92-6 of the Military Criminal Act, which criminalizes consensual same-sex sexual conduct among military personnel; 

26. With reference to the Committee’s general comment No. 36 (2018) on the right to life, the State party should implement measures to address the social root causes of suicide, including the very high levels of pressure in educational, working and military environments, and with regard to individuals in particularly vulnerable situations. 

32. The State party should strengthen the system and procedures for conducting transparent and fair investigations of human rights violations within the military, ensure that perpetrators are prosecuted and, if convicted, punished with appropriate sanctions, and that victims receive full reparations, including adequate compensationand legal, medical, financial and psychological assistance. It should also enhance efforts to reinforce the human rights protection system in the military and work to foster a culture that respects human rights in the military. 

52. The State party should eliminate the discriminatory treatment of conscientious objectors compared to those enrolled in military service by reducing the excessively long duration of alternative service and expand alternative service to locations other than correctional facilities. It should also consider amending its legislation to recognize the right to conscientious objection of active members of the armed forces and, in line with the Committee’s previous recommendations and Views, to provide compensation to conscientious objectors who, further to the Constitutional Court’s decision of 28 June 2018, have been released from prison and had their criminal records expunged.
