국회의 군사법원법 개정에 대한 故 윤 일병 어머니의 입장

 

 피 끓는 심정으로 호소합니다.

 

 2014년 4월, 제 금쪽 같은 아들, 윤승주 일병은 선임들의 지속적인 폭력과 가혹행위로 시달리다 세상을 떠났습니다. 당시 부대에서는 사건을 숨기기에 바빴습니다. 저도 처음에는 만두를 먹다가 기도가 막혀서 죽은 것으로만 알았습니다. 하지만 아들의 싸늘한 주검 속에 남은 수많은 상처들을 보면서 군 수사기관이 조직적으로 사건을 은폐하고 있다는 사실을 확인하게 되었습니다.

 

 대중의 기억 속에서는 잊혀졌지만 제 아들 또한 성추행 피해자였습니다. 당시 집단구타와 가혹행위의 형태가 너무나 심하고 엽기적이어서 아들이 선임들에게 당한 성추행은 여론의 주목을 받지 못했지만 제 아들 또한 성추행으로 인해 심한 고통과 성적 수치심, 모멸감에 떨었었습니다.

 

 최근 공군 중사 사망사건을 보면서 저는 또 다시 그날의 악몽을 떠올려야 했습니다. 추행 당하던 아들의 모습이 생각나서, 부대가 조직적인 은폐를 하던 모습이 생각나서 도저히 잠을 이룰 수 없었습니다. 하지만 절망 속에서 대통령의 강한 의지, 국방부 장관의 거듭된 사과와 민관군위원회가 결성된 것을 보면서 “그래, 지나온 세월이 있는데, 그래도 촛불로 탄생한 정부가 있는데 설마 그때와는 다르겠지”라고 제 자신을 다독여 가며 희망을 품었습니다.

 

 하지만, 또다시 2014년이 되풀이되는 것 같아 절망스럽습니다.

 

 군대 내에는 성폭력은 물론이며 억울한 죽음들이 여전히 많습니다. 군인권보호관이 불시에 부대를 방문해서 조사하고 민간법원에서 재판하면 지금 보다는 나을 것입니다. 전쟁 중이 아니라면 국민의 신뢰도 잃고 능력도 없는 군사법원이 존재할 까닭이 없습니다.

 

 그동안 군사법원이 제식구감싸기와 축소, 솜방망이 처벌로 일관했다는 것을 모두 알고 있는 사실입니다. 제 아들 사건 때도 그랬습니다. 그래서 그 때도 군사법원을 없애야 한다는 목소리가 높았습니다. 하지만 군의 결사적인 반대로 군사법원은 없어지지 않았습니다.

 

 이번에는 성폭력이나 군사망사건, 입대 전 범죄만 민간법원으로 넘긴다고 합니다. 성폭력 피해자가 사망했기 때문일 것입니다. 그렇다면 그 밖의 사건들은 공정하게 처리해왔기 때문에 군사법원에 남겨 둔 겁니까? 다른 가혹행위 등 인권침해 사건도 피해자가 사망해야만 민간법원으로 이관할 겁니까? 대체 왜 군사법원 하나를 없애지 못해 이렇게 돌아갑니까? 언제까지 피해자들이 죽음으로 호소해야 합니까? 도대체 국회의원은 뭐하는 것이며, 그동안의 국방부장관의 사과와 대통령의 엄벌 의지는 어디로 실종한 겁니까? 결국 말잔치에 불과했던 겁니까? 전국민을 대상으로 한 편의 사기극을 연출했던 겁니까?

 

이러한 군사법원법 개정은 윤 일병과 오대위, 죽음으로 호소한 공군 중사와 해군 중사, 자살을 시도한 육군 부사관, 그리고 지금도 숨죽이며 울고 있는 피해자들을 두 번 죽이는 것입니다.

 

저는 도저히 받아들 수 없습니다.

다시 제 아들의 울음소리가 들리는 것 같습니다.

다시 피 끓는 심정으로 호소합니다. 이럴 수는 없습니다.

 View on the Amendment of Court-Martial by Mother of Late PFC Yoon 

 

I plead with blood-curdling feelings.  

In April, 2014, my precious son, Army Private First Class Yoon Seungju, passed away after suffering from constant violence and bullying from the senior soldiers. At then, the military unit was busy covering up the truth. At first, even I thought he died of suffocation with dumpling stuck in his airway. However, after seeing numerous scars on the cold body of my son, I have confirmed that the military investigative agencies are concealing the case in an organized way.  

Though it has been forgotten in the memories of people, my son was also a victim of sexual molestation. Back then, my son’s damages from sexual violence did not gather much attention because the aspects of senior soldiers’ lynching and tortures were extremely grotesque and severe. However, my boy, too, trembled out of pain, sexual humiliation, and contempt due to sexual abuse. 

Recently, I had to recall the nightmares from the past again, reading the death of an air force sergeant first class. As the scenes came up to me where my son was molested and the military concealed the case in an organized way, I could not have slept well at all. Nonetheless, I patted myself and believed in hope to see the strong will of the President and repeated apologies of the Minister of National Defense, as well as the formation of the Civilian-Government-Military Joint Committee, thinking to myself: “Yes, time has passed; anyway, the Government was formed after the candlelight; it would be different this time.” 

However, it is depressing that things seem to repeat themselves from 2014 again.  

Still, there are a lot of victimized deaths, in addition to sexual abuse, in the military. If the office of military human rights protection may visit the military bases without prior notice and investigate cases, and if the trials are held before civilian courts, then it would be better than now. There is not a single cause to retain a court-martial that has lost people’s trust and has no competencies when we are not in wartime.  

We all know that the military court has consistently covered up for its own family member, downscaled a case, and continued impunity. It was not that different in my son’s case either. Thus, there were high voices calling for the end of court-martials back then. However, the court-martial remained due to the desperate resistance of the military.  

This time, it is proposed that the sexual crimes, death cases, and crimes committed before joining the military will be transferred to the civilian court. It is probably because soldiers passed away due to sexual crimes. If so, has the court-martial dealt fairly; is that why other crimes are still under the court-martial? Would they transfer bullying cases only if a victim dies in the case of other crimes? Why on the earth things work in this way, failing to simply remove court-marital, a single thing. Until when the victims should plead through deaths? What in the world the lawmakers do? Where are the apologies of the Minister and the will of strict punishment of the President gone? So, was all that just vein words? Was it a show of fraud against the whole nationals? 

Such an amendment is killing twice PFC Yoon, Cpt Oh, two sergeants in the Air Force and the Navy, recently departed this word, and an army noncom, recently attempted suicides, and other victims who would be crying in silence even now. 

I can never accept this.  

It feels like my son’s crying is heard again. 

I plead with blood-curdling feelings. This is just not it.
